In view of the rival submissions and also having considered the affidavit of the respondent no.2 as well as the injury certificate produced by learned APP, primafacie it appears that First Information Report has been filed as an arm twisting measures to pressurize for the recovery. The certificate, which has been produced of the General Hospital, Mehsana requires to be examined in background of the fact that without Police yadi, he has been admitted and the injuries are also required to be considered. Therefore, the matter requires detailed hearing.
Hence, following order is passed. Rule. Learned APP Ms.A.C. Raval for the respondent no.1State of Gujarat and learned counsel, Mr.Ankit Shah for the respondent no.2original complainant waive service of notice of rule.
Interim relief in terms of Para No.12(B) till final hearing.
