JUDGMENT / ORDER

Rule. Mr.IM Pandya Addl. Public Prosecutor waives service.
2.The parties do not press for reasoned order. Considering the submissions made on behalf of the parties, and having regard to the facts and circumstances of the case, the petition is allowed and the petitioner is ordered to be released on bail in connection with the Crime Register No.II-28 of 2002 of Jhagadiya Police Station on his executing a bond of Rs.5000/(Rupees Five Thousand only) with one surety of the like amount to the satisfaction of the lower Court and subject to the conditions that he shall, [a] not take undue advantage of his liberty or abuse his liberty.
[b] not act in a manner prejudicial to the interest of prosecution;
[c] maintain law and order;
[d] mark his presence before the concerned police station on every Monday for a six months and thereafter, once in a month on any day between 1st and 10th of every month for a period of six months;
[e] furnish the address of his residence at the time of execution of the bond and shall not change the residence without prior permission of this Court;
[f] surrender his Passport, if any, to the lower court within a week;
3.If breach of any of the above conditions is committed, the Sessions Judge concerned will be free to issue warrant or take appropriate action in the matter.
4.Bail bonds to be executed before the lower court having jurisdiction to try the case.
5.Rule is made absolute. Direct service is permitted.
