JUDGMENT / ORDER

1.The main appeal is already ordered to be expedited. The applicant had not pressed for bail on earlier occasion, as can be seen from the order of this Court passed on 28th February, 2001 in the main appeal. The applicant is involved in offences punishable under Sections 392, 397, 452 and 342 read with Section 34 of the Indian Penal Code and Section 135 of the Bombay Police Act and is sentenced to undergo rigorous imprisonment for seven years. As per the statement made at the Bar by learned Additional Public Prosecutor Mr. Abichandani, the applicant has undergone sentence of one year, seven months and fourteen days. It also transpires that he had enjoyed temporary bail and had surrendered late. In view of the above peculiar circumstances of the matter, this Court is not inclined to entertain this application. It would be open for the appellant to move a note for placing the matter on Board since the appeal is already ordered to be expedited. The application is rejected.
