Rule. Mr J T Trivedi, learned Advocate waives service of notice of rule on behalf of the respondents. By consent of the parties, this matter is being heard and disposed of finally. 2.This is an application for joining the respondents above named in place of deceased respondent - Rasiklal Acharya. The death certificate shows that the deceased has passed away on 19.6.1998 and the relevant document has been placed at Annexure 'A' showing that the said respondent has passed away on the aforesaid date. The contention of the applicant is that the aforesaid opponents are the legal representatives of the deceased. There is no dispute about the same.
3.In above view of the matter, this application is allowed. The above opponents are ordered to be joined in place of deceased Rasiklal Acharya in Misc.Criminal Application No.3901 of 1997. Rule is made absolute to the aforesaid extent. Cause title of Criminal Misc.Application No.3901/97 shall be amended accordingly.
