1.When the matter is called out for hearing, the learned advocate for the petitioner is not present. Mr.H.L.Jani, learned APP for the respondent - State is present.
2.In the present application, considering the prayer clause para-8(a), wherein, the prayer has been made by the petitioner that to quash and set aside the criminal complaint being Criminal Case No.2501/97 pending in the Court of J.M.F.C. 1st Court, Surat qua petitioners are concerned. Therefore, considering the prayer made in the petition and looking to the reasons and modification of sitting arrangement, the office is directed to place this matter before appropriate Court for taking necessary action under Section 382 of the Criminal Procedure Code.
