This appeal was time barred by 27 days. Misc. Criminal Application No.2136 of 2001 to condone the delay of 27 days in filing this appeal late is already dismissed today by separate order. Thus, this appeal is required to be dismissed as having become time barred. On merits also it cannot be said that the order of sentence of 3 years R.I. imposed by the learned Trial Court for the offence under Section 307 IPC is too lenient. On peculiar facts and circumstances of the case, I do not want to interfere with such order. Therefore, on merits also this appeal is required to be dismissed and accordingly the same is dismissed having become time barred as well as on merits also.
