JUDGMENT / ORDER

Considering several contradictions in the evidence of the complainant and the injured witnesses, the learned Trial Court gave benefit of doubt to the respondents-accused and acquitted them for the offences under Section 326 read with Section 114 IPC and Section 135 of Bombay Police Act, then this court would not interfere with such order of acquittal in this acquittal appeal for the incident which alleged to have taken place on 7.9.1993 at night hours. It was not possible for the witnesses to identify the accused. In such type of case when the learned Magistrate has given benefit of doubt, then this court would certainly not interfere with such order of acquittal in this appeal. Hence leave refused. Appeal dismissed.
