Shri Dabhi, learned Additional Public Prosecutor for the respondent State and perused the impugned judgment and order of acquittal passed by the learned Special Judge acquitting the respondent original accused for the offences punishable under Sections 323, 504 and 506(2) of the Indian Penal Code and under Section 3(1)(10) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is to be noted that earlier learned Single Judge has already granted leave to appeal to prefer appeal against the impugned judgment and order of acquittal dated 29.12.2011 by order dated 31.07.2012 passed in Criminal Miscellaneous Application No. 3611 of 2012. Hence APPEAL is ADMITTED.
Bailable warrant be issued against the respondent original accused in sum of Rs.5000/ . Registry is directed to return the R & P to the learned trial Court to prepare the paper book immediately .
