JUDGMENT / ORDER

The petitioner, an employee of the second respondent, had retired from service on 31.01.2010. His retirement benefits are being withheld by the second respondent, without any justification. A counter affidavit has been filed on behalf of the second respondent. 2. I have heard Adv.C.E.Unnikrishnan who appears for the second respondent as well as the learned counsel for the petitioner.

It is admitted by the learned counsel for the second respondent Bank that the Statutory Audit in respect of the Society for the year 2009-2010 is over and that the Audit Report has been received by the Bank on 23.07.2013. Audit Report in respect of previous years are also available with the Bank. The petitioner was in charge of an extension counter, that was being conducted by the Bank from 01.08.1997 to 31.12.2008. There are allegations that he had not maintained the accounts of the extension counter properly during the period that he was in charge. It was for the reason that the -2-
W.P.(C). No. 24850 of 2013 audit was not over, that the retirement benefits of the petitioner were not paid. The said reason does not survive at present, since the audit has been completed.
4. In view of the above, it is only appropriate that the second respondent finalises the proceedings for recovery of any amount due from the petitioner without further delay and disburses his retirement benefits to him.
This writ petition is therefore, disposed of directing the second respondent to finalise the question of fixing the liability on the petitioner, as expeditiously as possible, at any rate within a period of one month from the date of receipt of copy of this order. The retirement benefits of the petitioner shall be paid to him within a period of two weeks after the said proceedings are finalised.
