JUDGMENT / ORDER

The wife, who is the first respondent in G.W.O.P.No.38 of 2016 filed by the husband on the file of Principal District Judge, Theni, is the Petitioner. She seeks transfer of the same to Family Court, Madurai to be tried along with H.M.O.P.No.753 of 2016, which is pending on the file of Family Court, Madurai.
2.The said H.M.O.P.No.753 of 2016 has been filed by the wife for restitution of conjugal rights against her husband. The petition for divorce in H.M.O.P.No.108 of 2016 has also been transferred to Family Court, Madurai by order dated 20.06.2017 in Tr.C.M.P(MD)No.468 of 2016.
3.Considering the above facts and circumstances, this Transfer Civil Miscellaneous Petition is allowed and the Petition in G.W.O.P.No.38 of 2016 is withdrawn from the file of Principal District Judge, Theni and transferred to the file of Family Court, Madurai to be tried along with H.M.O.P.No.108 of 2016 and H.M.O.P.No.753 of 2016. The Principal District Judge, Theni is directed to despatch the papers in G.W.O.P.No.38 of 2016 to Family Court,Madurai within a period of two weeks from the date of receipt of copy of this order. The Family Court, Madurai is directed to dispose of the above three O.Ps' within a period of eight months from the date of receipt of the above proceedings from Sub-Court, Theni and the Principal District Judge, Theni. Consequently, connected Miscellaneous Petition is closed. No costs.
