JUDGMENT / ORDER

The wife is the first respondent in H.M.O.P.No.108 of 2016, on the file of Sub-Court, Theni filed by the husband seeking divorce on the ground of adultery as well as cruelty. She has preferred an O.P for restitution of conjugal rights in H.M.O.P.No.753 of 2016, which is pending on the file of Family Court, Madurai.
2.Admittedly, the wife is residing with her parents at Madurai. The husband happens to be a permanent resident of Theni.
3.Considering the convenience of the wife and the pendency of H.M.O.P.No.753 of 2016, on the file of Family Court, Madurai, this Transfer Civil Miscellaneous Petition is allowed and the Petition in H.M.O.P.No.108 of 2016 is withdrawn from the file of Sub-Court, Theni and transferred to the file of Family Court, Madurai to be tried along with H.M.O.P.No.753 of 2016, which is pending on the file of Family Court, Madurai. The Sub-Court, Theni is directed to despatch the records to Family Court,Madurai within a period of two weeks from the date of receipt of copy of this order. Consequently, connected Miscellaneous Petition is closed. No costs.
