C.P.Rasheed vs Meppadi Grama Panchayath

High Court Of Kerala|27 October, 2014
|

JUDGMENT / ORDER

This writ petition is filed challenging Ext.P6 order of the respondent by which the petitioner has been directed to stop the business being conducted by him for the past many years. According to the petitioner, Ext.P6 has been served all on a sudden, without he being put to notice of the proposed action at any point of time in the past. Though the petitioner has a statutory remedy against Ext.P6, he is not even in a position to invoke the said remedy for the reason that he would have to stop his business immediately. Therefore, the petitioner seeks the issue of some orders to enure during the interregnum within which he would invoke the said statutory remedy.
2. Since the petitioner has a statutory remedy against Ext.P6, it is only appropriate that the petitioner invokes the same without further delay. In order to facilitate the petitioner to invoke the said statutory remedy, I am satisfied that it is necessary to keep all further proceedings pursuant to Ext.P6 in abeyance.
This writ petition is therefore, disposed of relegating the petitioner to his statutory remedy against Ext.P6. All further proceedings based on or pursuant to Ext.P6 shall remain stayed for a period of 15 days from today.
