It is pointed out that similar writ petition no. 425 of 2010 which was listed today has been directed to be listed for final hearing on 11.03.2010, in view of the reasons mentioned therein and as an interim measure arrest of petitioners have also been stayed keeping in view similar order passed in the bunch of similar cases pending in Allahabad High Court. It is requested that this matter being identical be also clubbed along with that writ petition and the similar order be passed to which the learned Advocate General, U.P. has no objection.
Accordingly, as an interim measure, it is directed that till the next date of listing, the petitioners (C.B. Patodia and Mahesh Jain), shall not be arrested in Case Crime No. 07 of 2010, under Sections 3/7 E.C. Act and under Sections 420, 120, 120-B, 467, 468, 470, 471 I.P.C., Police Station Hargaon, District Sitapur, subject to their full co-operation in the investigation, which shall go on.
