JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, the petitioner initially entered the service of the respondent Bank as a Clerk and in due course got promoted as Manager. Initially, on 18.08.2011, when the petitioner applied for voluntary retirement on medical grounds, it is said to have been rejected by the respondent Bank holding that certain disciplinary proceedings were pending against the petitioner. Once the disciplinary proceedings were finalized on 16.10.2012, the petitioner renewed his request through Exhibit P2 on 12.07.2013. Complaining of inordinate delay in disposing of Exhibit P2 representation, the petitioner filed the present writ petition.

The respondent Bank filed its counter affidavit placing on record that Exhibit P2 was accepted by the respondent Bank through its letter dated 18.08.2014 and that once the petitioner reports for duty, the said letter dated 18.08.2014 would be given effect, thereby permitting the petitioner to retire voluntarily.
4. Having heard the respective counsel for the petitioner and the respondent Bank, this Court does not find any issue to be resolved, inasmuch as Exhibit P2 request of the petitioner stood accepted by the respondent Bank as could be seen from paragraphs 5 and 6 of the counter affidavit filed by it.

In the facts and circumstances, having regard to the respective submissions of the learned counsel for the petitioner and the learned Standing Counsel for the respondent Bank, this Court disposes of the writ petition with a direction to the petitioner to report before the authorities in terms of the letter dated 18.08.2014 of the respondent Bank to enable the authorities to take further steps in retiring the petitioner on voluntary basis. As soon as the petitioner appears before the authorities, needless to observe, the respondent may take expeditious steps in giving a finality to the proceedings of W.P.(c) No. 25226 of 2014 3 retiring the petitioner in terms of letter dated 18.08.2014.
With the above observations, this writ petition is disposed of.
