Petitioners happen to be constable and appear to be aggrieved by the impugned transfer orders dated 27.4.2010 and 29.3.2010(Annexure 1 to the writ petition).
It is contended that although the impugned transfer orders have been passed with approval of the Police Establishment Board but the approval has been given without application of mind. In such matters, this Court has passed an interim order on 7.5.2010 in Writ Petition No.25016 of 2010, against that State of U.P. has filed special appeal which was numbered as Special Appeal No.850 of 2010 and that was dismissed by this Court on 28.5.2010. In view of the above, learned Standing Counsel, who has accepted notice on behalf of the respondents, is granted six weeks' time to file counter affidavit. Rejoinder affidavit, if any, may be filed two weeks thereafter. List thereafter along with record of Writ Petition No.25016 of 2010. As an interim measure, without prejudice to the right and contention of the parties, it is provided that if the petitioners have not joined pursuant to the impugned orders, they will not be insisted to join at their transferred place till the next date of listing.
