JUDGMENT / ORDER

The petitioner is the fourth accused in C.C No.942/07 on the files of the Additional Chief Judicial Magistrate Court, Ernakulam. The offence alleged is punishable under Sections 405, 409, 420 read with 34 of IPC. It is submitted that the petitioner is neither the Director or an employee of the first respondent Company. She is the wife of one of the Directors of the Company and she has nothing to do with the first accused Company or has nothing to do with crime of mis-appropriation alleged against them. In the circumstances, the petitioner seek to quash the Calendar Case as against the petitioner. The Crl.M.C is dismissed without prejudice to the right of the petitioner to file an application for discharge within a period of two months. The personal appearance of the petitioner shall be dispensed with during the pendency of application for discharge. The non-bailable warrant shall be kept in abeyance till the disposal of the petition for discharge if any filed.
