The Correspondent vs Mrs.D.Sabitha

Madras High Court|06 September, 2017

JUDGMENT / ORDER

(Order of the Court was made by HULUVADI G.RAMESH, J.) Heard the learned counsel appearing for the parties for some time.
2. This Contempt Petition has been filed to punish the respondents herein for their willful disobediance of the orders passed by this Court dated 29.10.2014 in Writ Appeal No.1531 of 2012, wherein, a direction was issued to the second respondent therein to approve the appointment of J.Ramesh as Vocational Instructor in the petitioner's School.
3. It appears that though the appointment was made on 15.10.1997, almost two decades ago, the appointment was not approved by the respondents. Only pursuant to the direction of the learned Single Judge in the writ petition, the third respondent/Joint Director of School Education issued proceedings in Na.Ka.No.80004/V1/E3/2017, dated 30.08.2017 whereby from 09.02.2007 onwards, the appointment of the said Ramesh was recommended to be approved by placing him as Vocational Instructor Grade - I.
4. Such being the case, as a policy decision has been taken by the Government by according the sanctioned post and fixing the salary from the date of regularisation, this Contempt Petition is closed. However, if any clarification is required in relation to payment of salary or any remuneration from 15.10.1997, it is for the said J.Ramesh to make a representation to the Government and on receipt of such representation, the Government shall consider the same and pass appropriate orders as expeditiously as possible.
