This appeal is filed aggrieved by the judgment of the learned Single Judge directing the appellant, the Manager of an aided school, to forward the application made by the 1st respondent for leave without allowance for five years to the 3rd respondent with his recommendations. Grievance of the appellant is that the said direction obliges him to make positive recommendations and that such a direction could not have been issued by the learned Single Judge.
2. The learned Single Judge has only directed the appellant to forward the application made by the 1st respondent with his recommendations. That only means that the Manager will forward the application with his remarks as provided in Rule 58(2) of Chapter XIV-A of the Kerala Education Rules. It does not mean that such remarks should be a positive recommendation as now W.A.No.1375/14 -2-
canvassed by the counsel for the appellant. Therefore, we do not see any reason to interfere with the judgment.
The Writ Appeal fails and the same is dismissed.
