JUDGMENT / ORDER

The petitioner has come forward with this writ petition praying for issuance of a Mandamus to direct the fourth respondent to consider his representation dated 02.11.2016 and to pass orders thereon to carry out subdivision in respect of the roads situated in survey No's"56/1, 56/2, 57/1A in Kurukkupuram Village Revenue Records and field measurement book within a time to be specificed by this Court.
2. The petitioner claims that the lands mentioned above belongs to his wife, who has given a specific power of attorney in his favour to deal with those lands, particularly to ensure that proper sub-divison of the lands has been made by approaching the revenue authorities.

According to the learned counsel for the petitioner, in the lands which formed part of a layout called NPS Saraswathi Nagar, 150 plots were sold to various persons and one of those plots were purchased by the wife of the petitioner in the above said survey numbers. It is further submitted that the purchasers have also gifted certain lands in favour of the Kurukkupuram Village Panchayat for the purpose of forming road. According to him, inspite of execution of gift deed the panchayat failed and neglected to effect sub-division of lands by earmarking necesary space for the purpose of formation of roads. In this context the petitioner has submitted a representation dated 02.11.2016 to the respondents requesting to effect sub-dvision of the above said lands and also the roads for public use. However, till date the respondents have not carried out sub-division of the lands and therefore he prayed for issuing appropriate direction to the respondents.
4. On the above contention, I heard the learned Government Advocate appearing for the respondents.

Having regard to the facts and circumstances of the case, without expressing any opinion on merits, I direct the fourth respondent herein to consider the representation dated 02.11.2016 of the petitioner after hearing all the partis concerned and to pass orders thereon on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
6. With the above direction, the writ petition is disposed of. No costs.
