JUDGMENT / ORDER

This writ petition has been filed by the petitioner challenging the order of the dismissal.
The petitioner being a Constable in Central Reserve Police Force. Shri R.C. Shukla, learned counsel for the respondents raises a preliminary objection regarding maintainability of the writ petition that the writ petition is not maintainable. In view of the fact that the petitioner has an efficacious alternative remedy by way of filing an appeal under Section 28 of the Rules, this objection was initially taken in the counter affidavit.
In view of the aforesaid fact, this writ petition is dismissed on the ground of alternative remedy giving a liberty to the petitioner to file an appeal within a period of one month and if such appeal is filed within a period of one month then the Appellate Authority is directed to decide the same within a period of three months thereafter after affording full opportunity to the parties.
