By order dated 8.8.2017 in Writ-A No.33663 of 2017, this Court permitted the applicant to approach respondent no.2 i.e.
D.I.G. (Establishment) Police Headquarter, Allahabad in regard to his claim for promotion on the post of constable. There was a further direction to consider the claim of the applicant within four months from the date of receipt of certified copy of the order.
On matter being taken up today, Sri P.K. Giri, learned Additional Chief Standing Counsel has placed on record an order dated 6.12.2017 passed by Incharge D.I.G. (Establishment) U.P. deciding the representation of the applicant. In para 3 of the order it has been observed that Departmental Promotion Committee has not found the applicant suitable for promotion. In para 4 of the order it has been observed that the opposite party is not competent to examine the claim of the applicant for promotion, as the competent authority is Police Recruitment and Promotion Board.
Having regard to the above facts, this Court does not find any good reason to proceed any further against the opposite party.
The contempt application is consigned to record, leaving it open to the applicant to challenge the stand taken by the opposite party in case he feels aggrieved thereby.
