Heard Mr.Mitul R.Desai, learned advocate for the petitioner. It is submitted that the petitioner Company is a manufacturer, supplier and dealer of alloy, ferrous and other metals and supplies the same as per the specifications and requirements of its customers. That during the course of business, respondentCompany approached the petitioner for supply of various metals and orders were placed by the respondent for various metals, in the year 2009. The amounts of purchases have been debited regularly in the account of respondentCompany and in the Books of Accounts of the petitioner. The payments made in COMP/215/2012 2/2 ORDER respect of purchases have already been credited to the account of the Company. That, several cheques issued by the respondentCompany to the petitioner have not been realised due to instructions given by the respondent to the petitioner for not depositing the said cheques in the Bank. The outstanding amount to be paid by the respondent is Rs.3,26,940/, plus interest till the date of payment. The petitioner has sent statutory notice dated 25.02.2012 to the respondent that has been received by it, as is clear from the acknowledgment slip. However, in spite of receipt of the notice, no payment has been made by the respondent.
Issue Notice returnable on 07.11.2012. In addition to the normal mode of service, Direct Service is also permitted.
