Heard learned counsel for the petitioner, Sri Anil Kumar Goshwami representing the respondent no. 1 and Dr. Hari Nath Tripathi representing the respondent nos. 2 and 3.
The limited relief pressed before us by learned counsel for the petitioners is for an appropriate direction to the third respondent, Regional Officer, U.P. Pollution Control Board, Fatehpur Roshnai, Raniya, Kanpur Dehat, to consider the objections filed by the petitioners dated 23 January 2018 (Annexure No. 8 to this writ petition) against the proposal given by the respondent no. 4, Uttar Pradesh Waste Management Project (Division of Ramky Envior Engineers Ltd.) through its IWM-National Head, for grant of environmental clearance for setting up a Bio-medical Waste Facility before granting such clearance.
Sri Hari Nath Tripathi, learned counsel for the respondent nos. 2 and 3, submits that in case the clearance has still not been granted, objections of the petitioners would be considered.
Considering the facts and circumstances of the case, we dispose of this petition with the direction to the respondent No.3 to consider the objections of the petitioners before deciding the request of the respondent no. 4 for grant of environmental clearance, if not already granted, strictly in accordance with law, within a period of six weeks from the date of production of a certified copy of this order, after affording due opportunity of hearing to the petitioners and respondent no. 4.
