Heard Sri V. K. Singh and Sri P. K. Upadhyay, learned counsel for the petitioners, learned Standing Counsel for the State-respondents and Sri P. C. Pathak, learned counsel appearing for respondent no.5.
Sri V. K. Singh, learned counsel for the petitioners, has argued that the impugned order dated 05.02.2018 has been passed by the District Inspector of Schools, Aligarh disapproving the suspension of respondent no.5 without opportunity of hearing to the Committee of Management as per the law laid down by this Court in case of Hari Singh Rajput Vs. State of U.P., reported in 2015(3)ADJ 654.
In view of the above submission, learned counsel for the parties agree that the District Inspector of Schools, Aligarh may be directed to pass order in accordance with law keeping in mind the ratio laid down in the case of Hari Singh Rajput (Supra). The order dated 05.02.2018 passed by District Inspector of Schools, Aligarh / respondent no.4 is hereby quashed.
Writ petition is allowed.
Respondent no.4 / District Inspector of Schools, Aligarh is directed to pass reasoned and speaking order in accordance with law within a period of six weeks from the date of production of a certified copy of this order before him.
