Learned counsel for the petitioner submits that an application for granting recognition of Intermediate Science Group to the petitioner Institution , is pending before the respondent no. 3. An inspection has also been conducted in that regard. However, no finding decision has been taken on the claim of recognition to the Institution as an Intermediate Science Group. The petitioner has made a representation in this regard.
The only prayer made by learned counsel for the petitioner is that the application for grant of recognition to the petitioner Institution as an Intermediate Science Group may be decided within a stipulated period of time.
Learned Standing Counsel for the State-respondents submits that the matter is factual in nature and the issue of recognition of the Institution will be judged in the light of the existing standards and criteria for recognition by the competent authority.
No useful purpose will be served by keeping the writ petition pending. The writ petition is being disposed of finally with the consent of the parties.
The matter is remitted back to the respondent no. 3, Secretary, Madhyamik Shiksha Parishad, Allahabad.
The respondent no. 3 shall ensure that the due diligence exercise including physical inspection, checking of the credentials of the teachers and the staff, the infrastructure in the Institution and all other relevant criteria for the purposes of grant of recognition is conducted. The respondent no. 3 shall ensure that all criteria for recognition is strictly complied with. Upon consideration of relevant criteria, the respondent no. 3 shall pass a reasoned and speaking order in the matter in accordance with law.
The respondent no. 3 shall decide the representation of the petitioner for grant of recognition to the petitioner Institution as an Intermediate Science Group expeditiously preferably within a period of four months from the date of receipt of a certified copy of this order.
It is clarified that this Court has not judged merits of the claim of the petitioner or the veracity of the submissions made in the writ petition. It is for the competent authority to do so after independent application of mind upon all the relevant criteria.
The writ petition is disposed of finally.
