The prayer in this petition is for a direction upon the respondent concerned to consider the request of the petitioner institution for recognition upto the level of Intermediate in Science Group.
The learned Standing Counsel, who represents the respondents, has submitted that the prayer of the petitioner could be examined by the third respondent provided an application in proper form and in accordance with the Rules and Regulations has been submitted.
In view of the above, without expressing any opinion on the merits of the claim of the petitioner, this petition is disposed of by giving liberty to the petitioner to represent its cause before the third respondent (Secretary, Madhyamik Shiksha Parishad, Allahabad) by annexing therewith all the relevant documents to demonstrate that already an application in that regard has been submitted in the manner provided / prescribed by the Rules and Regulations. If any such representation is filed along with certified copy of this order, within three weeks from today, the third respondent shall examine first whether the application is in proper form and in accordance with the procedure prescribed and, if so, shall call for a report from the concerned authority and thereafter shall proceed to examine the records and take an appropriate decision, preferably, within a period of two months from the date of filing of such representation.
