Heard learned counsel for the petitioner, learned Standing Counsel and Sri Shivam Yadav for the respondents.
Committee of Management of Adarsh Janta Inter College has filed this petition for a direction upon the respondent no.3 to grant prior permission to fill up the solitary 01 post of Headmaster, 11 posts of Assistant Teachers, 01 post of Clerk and 02 posts of Class-IV employees in the institution. Claim in this regard has been raised before the authority concerned, which has remained pending since 7.11.2017.
Learned counsel appearing for the respondent no.3 submits that the claim of petitioner institution would be considered in accordance with law.
Considering the facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.3 to exercise his jurisdiction as is conferred under Rule 7(3) of the Uttar Pradesh Recognised Basic Schools (Junior High Schools) (Recruitment And Conditions Of Service Of Teachers) Rules, 1978 and take appropriate decision in the matter, in accordance with law, within a period of six weeks from the date of presentation of certified copy of this order.
