Despite service of notice upon the unofficial respondent No.6, none appears for him. We have heard the learned counsel for the petitioner.
After examining the matter in detail, the Hon’ble Lokayukta has entertained the complaint. However, we think that the Hon’ble Lokayukta has not been empowered to give any mandate, which has been given upon the Director of Town and Country Planning. Hence, we delete this portion of the direction. We however, direct the Director of Town and Country Planning to treat the findings of the Hon’ble Lokayukta, impugned herein, as a recommendation and take action in terms of Section 12(3) of the Andhra Pradesh Lokayukta Act, 1983. This shall be done within a period of three months from the date of receipt of a copy of this order in view of Sub-section of Section 12.
The writ petition is accordingly disposed of. Consequently, the miscellaneous applications, if any pending, shall also stand closed. No costs.
