Commissioner Income Tax vs Mohd. Maqsood

1. This is an appeal against the order of Income Tax Appellate Tribunal, Lucknow (the Tribunal) dated 24.8.2007 in respect of assessment year 1998-1999 affirming the order of Commissioner deleting the addition made by the assessing officer.

2. We have heard Shri A.N.Mahajan, counsel for the appellant and Shri S.D.Singh, cousnel for the assessee.

3. The Tribunal has held that there was no material before the assessing officer to show that the sale was bogus. The additions have been deleted on this ground.

4. This is a finding of fact. There is no illegality in the order. The appeal is dismissed.
