No. 367 of 2014 JUDGMENT: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) We have heard the learned counsel for the appellant and gone through the impugned judgment and order of the learned Tribunal and we are surprised that why this appeal has been preferred unnecessarily wasting the public exchequer.
The Revenue has accepted the settled law when the judgment passed by the learned Tribunal on an identical issue. There is no point for preferring the appeal.
Hence, the appeal is dismissed.
