Narasimha Sarma, learned counsel for the appellant, and gone through the impugned judgment and order of the learned Tribunal.
We are unable to admit the appeal on any ground as the learned Tribunal found that the preconditions for reopening of assessment under Section 148 of the Income Tax Act, 1961 are not satisfied. This fact finding has been arrived at by the Tribunal in paragraphs 9.5 and 9.6 of the impugned judgment.
Hence, we dismiss the appeal. There will be no order as to costs.
