JUDGMENT / ORDER

Hon'ble Dr. Satish Chandra,J.
A preliminary objection has been raised that this appeal is not maintainable in the light of the instructions of CBDT dated 15.5.2008 as the tax effect in the appeal was less than Rs. 4,00,000/-. As per the instruction of CBDT dated 15.5.2008, the appeal should not have been filed by the department as the tax effect was less than prescribed monetary limit. In view of the above, the appeal is dismissed in limine. Order Date :- 10.5.2010 VB/-
