1. We have heard Mr.Sudhir Mehta, learned counsel appearing for the revenue.

2. Admit. We formulate the following substantial question of law.

1. Whether the Appellate Tribunal has erred in law in not treating the income/profit declared by the assessee under the head "LTCG and STCG" on transfer of assets(shares) as "business income?"

3. Issue notice to the respondent. Paper book be filed within three months.
