(PER : HONOURABLE MR.JUSTICE AKIL KURESHI) Counsel for the Department pointed out that while disposing of the Tax Appeal No.1043 of 2009 and Miscellaneous Civil Application No.4 of 2012, we had carried out certain wrong impression of facts leading to dismissal of the said appeal.

For the reasons stated in Miscellaneous Civil Application and in view of the fair no objection granted by counsel for the respondent, we recall our order dated 15.3.2011 passed in Tax Appeal No.1043 of 2009.

Registry shall place Tax Appeal No.1043 of 2009 for admission hearing on 21.1.2013.

Miscellaneous Civil Application is disposed of accordingly.
