Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)
We have heard Mr. B. Narasimha Sarma, learned counsel for the appellant and we have gone through the impugned judgment and order of the learned Tribunal.
The learned Tribunal has passed an order while recording a finding that the pre-condition for initiation of penalty proceedings are not satisfied in the case. In that view of the matter, we do not find any infirmity or illegality in the judgment and order of the learned Tribunal.
The appeal is accordingly dismissed.
Consequently, the miscellaneous applications, if any pending, shall stand closed. No costs.
