Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)
We have heard Mr. B. Narasimha Sarma, learned counsel for the appellant and we have gone through the impugned judgment and order of the learned Tribunal.
The learned Tribunal has found on fact that the assessee has incurred expenditure. Moreover, on identical issue, various Benches of the learned Tribunal have taken consistent view and such view has been followed by the learned Tribunal by rendering the impugned judgment and order. We, therefore, do not find any infirmity or illegality in the judgment and order of the learned Tribunal.
The appeal is accordingly dismissed.
Consequently, the miscellaneous applications, if any pending, shall stand closed. No costs.
