We have heard Sri B. Narasimha Sarma, learned counsel for the appellant, and gone through the impugned judgment and order of the learned Tribunal.
We find that the learned Tribunal has followed the decision of

Madras High Court in C.I.T. Vs. Jain Housing & Construction Limited on the issue involved and passed the impugned judgment.
It is not argued that the aforesaid decision has no manner of application to this case. Therefore, we do not find any reason to interfere with the judgment of the learned Tribunal.
The appeal is accordingly dismissed. There will be no order as to costs.
