NO.288 OF 2014 JUDGMENT: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) We have heard the learned counsel for the appellant and gone through the impugned judgment and order of the learned Tribunal and we find that the Tribunal has passed order remanding the matter for hearing on the issue involved. We, therefore, do not want to interfere with the order.
The appeal is accordingly dismissed. There will be no order as to costs.
However, we direct the learned Advocate for the appellant to furnish a photocopy of the impugned judgment and order and include the same in the second copy of the appeal papers by Monday (28.4.2014). The Registry to report to this Court in case of non- compliance.
