… Appellant ….Respondent Judgment : (per Hon’ble Sri Justice Sanjay Kumar) The Revenue is in appeal against the miscellaneous order dated 8.1.2014 passed by the Customs, Excise and Service Tax Appellate Tribunal, South Zonal Bench, Circuit Bench of Hyderabad in St/Stay/26786 of 2013 in Appeal No. ST/26452 of 2013.
By the said order, the Tribunal directed the assessee to remit Rs.30.65 lakhs within a time frame and subject to the said condition, stayed further proceedings for realization of the adjudicated liability pending disposal of the appeal. The Tribunal recorded its reasons as to how the amount directed to be deposited was arrived at. The amount involved in the appeal was substantially higher than that directed to be deposited as a condition precedent for granting stay. The order under appeal however reflects the reasoning of the Tribunal for scaling down the amount. We therefore find no reason to interfere in the matter. The order under appeal is accordingly confirmed.
The appeal is devoid of merit and is consequently dismissed. No order as to costs.
