JUDGMENT: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)
We have gone through the impugned judgment and order of the learned Tribunal.
It appears, the matter has been disposed of by the learned Tribunal, by following the earlier decision of the assessee’s own case rendered by it in Madras Cements Ltd., vs. C.C.E., Trichy reported in 2009(245) E.L.T. 502 (Tri. Cehnnai).
Nothing has been placed before us to show that the aforesaid decision of the learned Tribunal, Chennai has been upset. The material placed before us show that some thing is pending before the Hon’ble Supreme Court. But, it is not clear from the material that the aforesaid decision of the learned Tribunal at Chennai has been upset by the Hon’ble Supreme Court.
Hence, we dismiss the appeal. No costs.
