Present revision has been filed against the provisional assessment order dated 24th October, 2011 passed by the Commercial Tax Tribunal, Ghaziabad in Second Appeal No. 389 of 2010 for the Assessment Year 2008-09, July, 2008.
Sri B.K.Pandey, learned standing counsel has fairly stated that since the revision has been filed against the provisional assessment order and the Tribunal has recorded finding of fact that the regular assessment order has been passed, therefore, the present revision has become infructuous.
Accordingly, the present revision is dismissed as infructuous.
