(PER : HONOURABLE MR.JUSTICE VIJAY MANOHAR SAHAI) 1. We have heard Mr. Ramesh V. Savania, learned counsel appearing for the petitioner and Mr. Rakesh R. Patel, learned Assistant Government Pleader appearing for respondent Nos.1 & 2.

This petition has been filed by the petitioner challenging the order dated 24.7.2012 whereby the contract floated by the respondent Nos.1 & 2 has been awarded to respondent No.3 by renewing his earlier contract and rejecting the tender of the petitioner though the petitioner was the lowest bidder.
3. The offer made by the petitioner was Rs.65,000/- per month, whereas the earlier contractor was doing the work for Rs.25,000/- per month. Therefore, the respondent No.1 took a decision that since the amount offered by the petitioner is on a higher side, they continued with the old contractor and renewed his contract for lesser amount of Rs.25,000/- per month. Hence, the respondents cannot be compelled to enter into contract with the petitioner and it is always open to the respondent No.1 to cancel the contract and renew the contract of the earlier contractor.
4. For the aforesaid reasons, we do not find any merits in this petition. This writ petition fails and is accordingly dismissed.
