JUDGMENT / ORDER

The petitioner wants to remove earth from the top portion of granite quarry. The petitioner is the holder of permit. Exts.P1 and P2 are the permit. It seems the Geologist insisted for production of environmental clearance for removal of the top soil. This issue is covered in favour of the petitioner by Exts.P3 and P4. The petitioner further submits that the Geologist also insisted for filling the existing pit by using top soil. It is held in Ext.P4 judgment that it is not necessary to compel any person to fill the pit with top soil. If any danger is caused, it is open for the Geologist to ask the petitioner to take necessary steps to fill the pit in accordance with conditions imposed in the permit. In view of the matter, necessary 'P' form shall be issued to the petitioner on being satisfied with any other claim to transport the quantity for removal of top soil from WP(C).No.28798/2014-Y.

Writ petition is disposed of as above.
