C.Nachimuthu Gounder vs The Inspector Of Police

Madras High Court|05 October, 2017

JUDGMENT / ORDER

This Criminal Original Petition has been filed seeking a direction to the 1st and 2nd respondent police to provide necessary protection in respect of their life and liberty to the petitioner and his family members and also to proceed the investigation without any delay.
2. In connection with the sale of a property between the third respondent and the petitioner's son, the petitioner as well as his family members apprehends danger to his life and liberty, pursuant to which, he had sought for protection from the first respondent police. Since the petitioner's request was not considered, he has filed present petition seeking police protection.
3. Heard Mr.Sathishkumar, learned counsel appearing for the petitioner and Mr.P.Govindarajan, learned Additional Public Prosecutor appearing for the respondents 1 and 2. Though, notice was served on the third respondent and his name is also printed in the cause list today, none appears for him.
4. The petitioner has produced sufficient materials including FIR dated 07.07.2017 filed against the third respondent, which evidences that there is a dispute between the third respondent and the petitioner's family members. In view of the same, the apprehension that there could be some threat to the life and liberty of the petitioner and his family members from the third respondent seems reasonable. Hence, the petitioner is at liberty to approach the first respondent police seeking for necessary police protection and on receipt of such an application, the first respondent police shall consider the same preferably on the same day and afford necessary protection to the petitioner and his family members.
5. With the above observations, the Criminal Original Petition stands allowed.
