C.M.Shajina vs State Of Kerala

High Court Of Kerala|07 October, 2014

JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents 1 to 4, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, the petitioner has approved service as High School Assistant (Natural Science) in the fifth respondent aided school in different spells. The last phase of approved service commenced on 16.09.2012. Though initial salary was paid regularly, later, there seems to be discontinuation. Under those circumstances, the petitioner filed the writ petition seeking a direction to the authorities to pay the salary regularly, apart from their paying all the arrears that have been accrued so far.
WPC 22375/14 2
3. The learned Government Pleader on instructions has stated that there is no dispute about the petitioner's entitlement to get salary for the periods in question. He has also stated that from January 2014 till last month, the salary has already been paid. In so far as the rest of the period is concerned, the Headmaster of the fifth respondent school is yet to submit the relevant bills to enable the authorities to process the same further.
4. Since neither of the parties in the writ petition is at issue, it serves the interest of justice if the writ petition is disposed of with the following direction:
The sixth respondent is directed to submit the relevant bills concerning the salary arrears of the petitioner to the fourth respondent as expeditiously as possible, at any rate, within a period of three weeks from the date of receipt of a copy of this judgment. Once the said bills reach the fourth respondent, the said authority shall process the same further and sanction the salary arrears to the petitioner WPC 22375/14 3 within a period of two months thereafter.
With the above observation, the writ petition is disposed of. No order as to costs.
