JUDGMENT / ORDER

Mr.K.V.Dhanapalan, the learned Special Government Pleader would submit that the order, which is the subject matter of contempt, has been complied with vide proceedings of the Special Tahsildar, Natham, Ambattur, in RC.No.119/17 dated 13.02.2017 and he also produced the copy of the said proceedings before this Court. The same is taken on file and recorded.
2 The Learned counsel appearing for the petitioner would submit that the said officials without taking note of the relevant facts and circumstances on record, has suggested and advised the petitioner to negotiate with the 4th respondent to make an agreement of partition of the property.
3 A perusal of the above said communication would disclose that the plea made by the petitioner was considered by the Special Tahsildar (Natham Settlement), Ambattur and vide proceedings in S.R.184/2015, dated 04.08.2015, after inspecting the site, has observed that the petitioner has occupied a small portion of the land in question by way of a hut and major portion of the land is enjoyed by Tmt.Chellammal and there is no documents to prove their individual enjoyment and in the light of the same, separate Patta is given.
4 In the light of the said stand taken, the petitioner is at liberty to workout his remedy in accordance with law, if he is so advised and if it is open to him under law, he is at liberty to challenge the said communication dated 13.02.2017, before the competent forum.
5 Recording the same, the contempt petition is closed.
