Heard Ms. Paurami B. Sheth, learned advocate for the petitioner. It is submitted that the petitioner Company had made an advance of Rs.12,50,000/- to the respondent Company. The liability was accepted by the respondent Company. Eight cheques were given by the respondent Company, which were dishonoured. The respondent Company did not make good the amount due to the petitioner, therefore, the petitioner issued a Statutory Notice dated 26.05.2012. It is further submitted that in spite of having acknowledged its liability earlier, the respondent Company denied the same in its reply to the Notice. It is further submitted that the petitioner is unable to pay its debts and honour its commitments, therefore, it deserves to be wound up.

Learned advocate for the petitioner is permitted to serve the Notice by RPAD, at the cost of the petitioner.
