JUDGMENT / ORDER

Petitioner is accused in Crime No.1524 of 2012 of the Taliparamba Police Station for the offence punishable under Sec.436 of the Indian Penal Code, apprehends arrest and has filed this application.
2. Learned Public Prosecutor has opposed the application.
It is submitted that on 23.11.2012 at about 12.30a.m, motor cycle of the de facto complainant kept in his porch was set fire. Petitioner is a suspect in the case.
3. Learned counsel submits that the petitioner is presently abroad and is willing to co-operate with the investigation of the case. It is also submitted that the petitioner is not involved.
4. Whether the petitioner is involved in the incident or not is to be ascertained in the investigation. Request for pre-arrest bail cannot be allowed but I am inclined to issue directions.
(i) Petitioner shall surrender before the officer investigating Crime No.1524 of 2012 of the Taliparamba Police Station within two weeks from this day.
(ii) In case interrogation is not completed that day, it is open to the officer concerned to B.A.No.4271 of 2014 2 direct presence of the petitioner on other day/days and time as may be specified by him which the petitioner shall comply.
(iii) In case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
The application is disposed of as above.
