C.Krishnamoorthy vs The District Revenue Officer

Madras High Court|20 November, 2017

JUDGMENT / ORDER

By consent, this writ petition is taken up for final disposal at the stage of admission itself.
2. Mr.J.Gunaseelan Muthiah, learned Government Advocate, takes notice for the respondents.
3. According to the petitioner, the subject mentioned property belongs to him, whereas, in revenue records, the same is wrongly mentioned as Sarkar Pathai Poramboke. In order to rectify the mistake crept-in, the petitioner has submitted several representations and after some rounds of litigation, they came to be rejected. Aggrieved over the same, the petitioner has preferred a revision before the first respondent on 29.08.2016. Pending disposal of the revision, the third respondent has issued notices to the petitioner, directing him to vacate and hand over the premises and having left with no other option, the petitioner is before this Court, seeking a direction for early disposal of the said revision.
4. Considering the facts and circumstances of the case and also the limited scope of the relief sought for, this Court, without going into the merits of the case, directs the first respondent to dispose of the revision of the petitioner dated 29.08.2016 and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner and all the interested parties, if any, within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of. No costs.
To
1.The District Revenue Officer, Collectorate, Trichy.
2.The Revenue Divisional Officer, Musiri, Trichy District.
