JUDGMENT / ORDER

Petitioners are accused in Crime No.75 of 2014 of the Perumannamuzha Police Station for the offences punishable under Sections 143, 147, 148, 341, 447, 323, 324, 326, 506(ii) and 307 read with Sec.149 of the Indian Penal Code, apprehend arrest and have filed this application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that on 18.03.2014 at about 5.30 p.m the petitioners and others trespassed into the compound of the de facto complainant and attacked him with stone. The 1st accused attacked the de facto complainant with a stone kept in a cloth and the 3rd accused assaulted the de facto complainant with a stone. The 2nd accused is involved in three other cases.
3. Learned counsel submits that the allegations are false and due to political rivalry petitioners are implicated in the case.
4. Having regard to the circumstances of the case I am inclined to think that request for pre-arrest bail cannot be allowed. These accused if so advised can surrender before the Investigating B.A. No. 3224 of 2014 -: 2 :-
Officer and in case they are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of as above.
